1. Acceptance of these terms

These Terms & Conditions (“Terms”) govern your use of the Orca Weather mobile application and the orcaweather.com website (together, the “Service”). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

Orca Weather provides weather information, combining data from the National Weather Service, public traffic and weather cameras, personal weather stations, and reports submitted by users. The Service is free to use and currently offered without ads or paid subscriptions.

3. Weather information disclaimer

Weather information provided by the Service — including forecasts, nowcasts, fog scores, camera imagery, and user reports — is provided for general informational purposes only. It may be incomplete, delayed, or inaccurate. Do not rely on the Service for decisions involving safety of life or property. For official warnings and safety-critical information, consult the National Weather Service (weather.gov) and local authorities.

4. Accounts

Some features, such as submitting reports and photos, require an account created by signing in with Apple or Google. You are responsible for activity that occurs under your account. You may stop using the Service at any time, and you may request deletion of your account and associated data as described in our Privacy Policy.

5. User content

You retain ownership of the reports, photos, and other content you submit (“User Content”). By submitting User Content, you grant Orca Weather a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content within the Service — for example, showing your fog report and photo to other users on the map and in the feed.

You represent that you have the rights to the content you submit and that it does not violate any law or the rights of others.

6. Acceptable use

When using the Service, you agree not to:

  • submit content that is unlawful, harassing, hateful, obscene, or that invades another person’s privacy (including identifiable photos of people taken without their consent);
  • submit deliberately false or misleading weather reports;
  • interfere with or disrupt the Service, or access it using automated means at a volume that degrades it for others;
  • attempt to gain unauthorized access to accounts, systems, or data.

We may remove content and suspend or terminate accounts that violate these Terms.

7. Third-party data and services

The Service incorporates data and imagery from third parties, including the National Weather Service, Caltrans and ALERTCalifornia public cameras, and Weather Underground personal weather stations. That data belongs to its respective providers and is subject to their terms. We do not guarantee its availability or accuracy.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORCA WEATHER AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, INCLUDING RELIANCE ON ANY WEATHER INFORMATION IT PROVIDES.

10. Changes to the Service and these Terms

We may modify or discontinue the Service at any time. We may also update these Terms from time to time; the “Last updated” date above reflects the current version. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law provisions.
